New Construction Utility Rates, Charges, and Fees

The following sections are excerpted from Title 5 of the City of Delray Beach, Florida Code of Ordinances, entitled "Public Works". They are intended to present the City's current utility rate structure and associated user fees and charges for connection to and service from the City's water and sewer systems. For more detailed information, please refer to the City's Code of Ordinances.

CURRENT CHARGES (Ref. Ch. 52, Sect. 52.31)

  1. Required. In addition to the meter installation charge, there shall be connection charges as follows:
    1. There shall be a water connection charge of $788 per connection of each residential unit. One residential unit connection is herein defined to be any family living unit, and, where two or more families are living on the same premises, each shall be considered as a separate residential dwelling unit. In apartment buildings, condominiums, cooperatives, duplexes, resort dwelling units, and the like, and per each trailer space in a trailer park, each living unit shall be considered as one residential unit connection.
    2. There shall be a nonresidential and irrigation water connection charge which shall be based on $788 per Equivalent Residential Connection (E.R.C.). The following water connection charges are hereby established for nonresidential and irrigation service:

  2. Outside city. The connection charges to users wholly outsides the corporate limits of the city shall be 25% higher than for the applicable charge to users within the corporate limits of the city
  3. Limitation on use of fees. The connection fee received by the city under this section shall be used for the purpose of providing the pro rata shares of construction costs to install adequate size major water distribution lines, ground storage tanks, and repumping facilities all in conformance with the city's water master plan and for any other capital expenditures caused by new users or as pledged impact fees. The city shall establish a separate account into which these fees shall be deposited. The money in this account shall be expanded by the city only for the herein referred to purposes and these expenditures shall only be made for locations in reasonable proximity to the development or unit for which the fees were charged or in locations and for projects which are directly impacted by the development.
  4. Subject to the applicability of Sec. 50.03, any connection fee for a given residential dwelling unit or its equivalent required under this section shall be paid in full prior to the issuance of any authorization to connect to the city's water system.

DEPOSIT TO GUARANTEE PAYMENT (Ref. Ch. 52, Sect. 52.33)

A guarantee-of-payment deposit for all bills shall be made by each consumer or owner, varying according to the size of the meter in use, as follows:

WATER RATES (Ref. Ch. 52, Sect. 52.34)

  1. For the purpose of this section the following definitions shall apply unless the context clearly indicates or requires a different meaning.
    1. "CAPACITY CHARGE." The charges calculated to cover costs incurred to have the system available and in good operating condition without regard to use, which shall include, but not be limited to, cost of minimum personnel, capital outlay, debt service, insurance, transfers, reserve requirements, and debt service coverage.
    2. "COMMODITY CHARGE." The charges calculated to cover the costs incurred which vary with the level of service provided, the amount of water produced or sewage processed, which shall include, but not be limited to, costs of personnel to operate the system, electricity, repairs, and maintenance, and operating supplies.
    3. "CUSTOMER CHARGE" The charges calculated to cover the costs incurred in the billing system, which shall include, but not be limited to, costs of meter reading, recording, data processing, billing, and collecting.
    4. "RESIDENTIAL DWELLING UNIT." One or more rooms connected together, constituting a separate, independent housekeeping establishment and physically separated from any other dwelling unit which may be in the same structure, and which contains independent sanitation, living, cooking and sleeping facilities.

  2. Monthly rates: The monthly rates (except for fire hydrants as set forth in Sec. 52.03) for water furnished by the water facilities or plant of the City to customers within and outside the corporate limits of the City, which unless otherwise indicated shall include the appropriate customer charges, capacity charges, and commodity charges for all customers, are fixed as shown in a table on the "Residential Customer" page in the Finance Department's area of this website."


    NOTE: Whenever both residential and nonresidential users are on the same meter, the capacity charge is to be computed at the nonresidential rate.

  3. Emergency Rate Adjustment for Water Conservation. During periods of mandated water restrictions by the South Florida Water Management District, an automatic surcharge shall be added to the commodity charge according to the following schedule for all water used in excess of 15,000 gallons by any customer in any one month:

SEWER RATES AND CHARGES (Ref. Ch. 53, Sect. 53.130)

  1. Connection Charges.
    1. In addition to the rates set forth in Section 54.130 (D), there is established a sewer connection charge for each connection to the City sewage collection system. The sewer connection charge shall be $1,084 for each separate residential unit or per Equivalent Residential Connection for non-residential units. A residential dwelling unit is defined in Section 53.004.
    2. Connection charges by users of the City sewage system wholly outside the corporate limits of the City are fixed at sums equal to rates shown in the above schedule in division (A) of this section, plus twenty-five percent (25%) of each respective classification. The connection charge shall be paid to the City at the time of obtaining a permit for a connection and shall be in addition to the permit fee. The size of the connection shall be determined by the Plumbing Inspector in accordance with Articles 7.6 and 7.7 of the Land Development Regulations.

  2. There shall be a non-residential sewer connection charge shall be based on $1,084 per Equivalent Residential Connection (E.R.C.). Equivalent Residential Connection shall be calculated as follows:

    Where an estimated flow is not available, the following formula shall be used with reference to the Standard Plumbing Code adopted by reference in Article 7.6 of the Land Development Regulations.

  3. The following rates and charges shall be collected from the users of the City sewerage system:
    1. Residential dwelling units. A monthly sanitary sewer service charge is imposed upon each residential dwelling unit, as more specilfically set forth hereinafter, to which sanitary sewage service is available through the facilities afforded by the municipally-owned sewerage system, according to the following schedule:

      NOTES: Where no water service is provided and the user is connected to the sanitary sewer system, there shall be a monthly customer charge of $5.00 per residential dwelling unit, and the commodity charge shall be based on the maximum of 12,000 gallons. This is in addition to the capacity charges as set forth above.

      Where no water service is provided and the user is not connected to the sanitary sewer system, and sewer service is available for connection, there shall be a monthly customer charge of $5.00 per residential unit and a capacity charge as set forth above.

    2. Nonresidential/commercial units. A monthly sanitary sewer service charge is imposed upon each commercial and nonresidential unit to which sanitary sewage service is available through the facilities afforded by the municipally-owned sewerage system, according to the following schedule:

      NOTE: (1): For those nonresidential/commercial units where water service is not available, and the user is connected to the sanitary sewer system or sewer service is available for connection, there shall be a monthly customer charge of $5.00 and a capacity charge as set forth above. The commodity charge shall be based on the average usage for the type of business or nonresidential use.

      NOTE: (2): The customer charges and capacity charges as set forth in this section shall be due and payable each and every month, regardless of whether or not the water service is available or the water meter is actually turned on or off and without regard to usage occupancy.
